Question 1 – How do you define value in the context of healthcare compliance? What kinds of value can compliance create? 

Lisa Herota – Compliance has a positive impact on financial, clinical and operational outcomes when we manage compliance well overall, not just by avoiding penalties.  

We help the organization safeguard the mission and reputation by: 

• Protecting revenue  
• Enabling ethical growth 
• Maintaining patient safety 

We do this all while also making our leaders feel more confident. They can make informed decisions through a compliance mindset, versus just worrying about how we’re going to avoid a penalty. 

Q 2 – Can you share examples of how you’ve created value or seen others do it? 

LH – One approach I’m proud of is strengthening organizational trust and reputation by developing a culture of compliance. This happens through:  

• Rounding and being present in the organization 
• Doing trainings  
• Partnering with leaders, medical staff, employees and even patients 

I’ve taken compliance teams from being the department where ideas go to die or the “Department of No” to being seen as a function that engages and supports. We became a resource that leaders want to bring to the table at the beginning of projects and discussions as a support versus just somebody to call when things go wrong. 

Q 3 – How do you measure and quantify compliance value?  

LH – I love data. I preach data, data, data to all compliance leaders. There are lots of different metrics we don’t think about, but many times, we just look at how we avoid fines. 

Actually, compliance has a lot of data for leaders to study. We can:  

• Look at percent of applicable regulations implemented on time.  
• Look at number and severity of audit findings or corrective action plans implemented.  
• Trend reported issues and how quickly those issues were resolved.  

Compliance Metric: Tracking the Near Misses 

Something that compliance leaders don’t think about often enough are the near misses. We usually think about these situations in patient safety and quality. But many times, compliance can help with close calls, and we should track those.  

Compliance Metric: Financial Value from Correct Regulation Implementation 

Common examples of financial value derived from correctly implementing new regulations include: 

• Reductions in external legal expenses 
• Decrease in denials and claw backs or repayments 
• Additional revenue capture  

Compliance Metric: Operations Staff Hours Saved 

You can talk to your operational leaders about how their team workloads benefit, especially if you have good regulatory change management tools with reporting and dashboards. Many times, I’ve tracked the number of hours saved that operational leaders don’t have to spend reading through regulations to decipher and interpret them.  

Department heads save valuable time when we provide them with tools like policy templates, implementation information, and the interpretation of the regulation itself. So, the hours compliance saves other department leaders is a good metric, too. 

Hard for Compliance to Quantify: Harm Avoidance  

It’s difficult for compliance professionals to quantify how they help the organization avoid harm. It’s definitely easier for revenue-generating departments to show their value, because they can measure the revenue they drive.  

But compliance often concentrates on how we avoid fines, and it’s hard to prove we’ve truly avoided something when the attitude is “Maybe we wouldn’t have gotten that fine anyway, regardless of what we do or don’t do.” That’s why I focus on other metrics. 

Q 4 – Who needs to know about the value that compliance creates, and how do you communicate that? 

LH – That’s a great question. There are various levels across any health system or organization that need to know the value that compliance has created, but the way you report it is going to look different based on whom you’re talking to.  

Talking to the Board 

When I’m presenting to my board or board committees, I target risk mitigation trends, assuring them we’ve got this. I use heat maps that show risk rankings, prioritization and key regulatory risk areas. I use implementation rates or key issues identified and resolved. When I’m talking to my board, I highlight how compliance work aligns with the strategic priorities of the organization.  

Talking to the Executive Team 

But when I’m talking to my executive team, I might get a little more granular with how many reduced denials or repayments or how many claw backs we avoided. Also, that metric about saving frontline leaders’ time, because that affects their operational teams as well as alignment with patient safety, quality and patient experience goals. A key metric is showing executive leaders how compliance ties into all the other objectives that the organization is trying to accomplish.  

Talking to Operational Leaders and Frontline Teams 

It’s a very different story when I’m talking to operational leaders or frontline staff.  With them, I focus on how I’m helping them succeed:  

• Fewer surprises related to regulations that apply to them 
• Reduced fire drills from reactive implementations versus steady, methodical implementation of regulatory change. 
• With good policies, procedures and training 

With frontline staff, it’s all about what compliance does. Proving compliance value is about showing them how we:  

• Impact their day-to-day reality. 
• Make changes to protect them and their patients. 
• Help make their work easier and safer. 

Really, it’s all about how we help support them and affect their day-to-day work. 

Tie Compliance Work to Strategic Goals for Value Recognition 

To overcome compliance reporting roadblocks, I go back to tying compliance’s work directly to the organization’s strategic goals. Just connect what we do to what the organization is focused on. Show how what we do impacts quality, CMS, star ratings, financial stability, the growth of new service lines and innovation.  

We need to connect what we do to optimizing and streamlining those goals and processes. 

Q 5 – What feedback have you had about compliance metrics and value? 

LH – One of the stories I love to share is about the day I was presenting a regulatory change management dashboard to my board. The very first time, I showed them that over the course of a year, the compliance team had touched over 535 regulations. It was the height of Covid, and when I presented that dashboard, board members just sit back in their chairs almost with a collective sigh.  

And they said, with the data you present, we can see what’s happened to the organization. We’re not just hoping we’re compliant. Now we can prove it. We can show that the organization truly is operating in a compliant manner. That was one of my biggest takeaways from frontline leaders.  

Other feedback I’ve received includes: 

• “I feel like compliance is supporting and partnering with me, not just telling me no or being a barrier.” 
• “When we streamlined compliance tools, that really helped support compliance functions.” 
• “Compliance saves us time and work by not having to review, interpret and decipher complicated regulations.”

The Nurse Who Slipped Through: A Tale of Missed Screenings and Million-Dollar Consequences 

ABC Health, a mid-sized midwestern provider, was thriving. With a regional flagship hospital, six outpatient clinics, a home health division, and a solid reputation for quality care, the CEO had just signed a five-year partnership with a major insurance network.  

There didn’t seem to be any cause for worry. The compliance officer insisted they ran exclusion screenings every quarter—plenty often, the executive claimed. 

Tech Failure Leads to “Minor” Exclusion Screening Lag 

But in Q3, the exclusion screening software glitched. It missed a monthly sync. Then a second. By the third missed month, the compliance officer dismissed it as “a minor lag,” promising the HR department everything would be rerun soon. 

Unfortunately, even a seemingly small glitch can have major consequences for healthcare compliance. 

ABC Health hired a new nurse in October. Her references checked out. She had a glowing record of employment. However, as it turns out, two years ago, she was convicted of Medicaid fraud while working under a different name in the southwest. She was on the OIG Exclusion List under her maiden name. 

But no one screened her for her maiden name at any time. 

Billings Accrue for Excluded Individual Over 11 Months 

The nurse worked at ABC Health for eleven months. In that time, she administered care to over 200 Medicare patients. ABC Health billed CMS more than $1.2 million for services in which she had direct or indirect involvement. 

In August of the following year, a whistleblower complaint hit the OIG hotline. An old colleague recognized the nurse’s face on ABC Health’s website. An investigation followed swiftly. The OIG cross-checked full names and dates of birth, matched alias records, and confirmed: ABC Health had employed an excluded individual. 

A Perfect Storm of Compliance Failure 

What followed was a perfect storm: 

• CMS demanded full repayment of $1.2 million in federal reimbursements. 
• Civil monetary penalties were levied—$20,000 for each false claim filed involving the excluded nurse. 
• The DOJ initiated False Claims Act proceedings, arguing gross negligence in compliance. 
• The state Medicaid program joined the fray, adding $400,000 in additional penalties. 

As this example shows, the fines, penalties, and reputational damage from exclusion failures are significant.  

Exclusion Screening as Compliance Practice and Risk Protection 

The OIG has the authority to exclude individuals and entities from federally funded healthcare programs pursuant to the Social Security Act and maintains a list of all currently excluded individuals and entities called the List of Excluded Individuals/Entities (LEIE). Anyone who hires an individual or entity on the LEIE may be subject to civil monetary penalties (CMP).  

Exclusion screening is critically important for healthcare provider organizations because failing to do it properly can result in severe legal, financial and reputational damage.  

Here are five reasons why you should take a look at your exclusion screening practices: 

1. It’s a Legal Requirement. 

Federal law prohibits payment by Medicare, Medicaid or other federal healthcare programs for any item or service furnished by an excluded individual or entity. This includes not just direct patient care but indirect services (e.g., billing, transportation, administrative work). 

2. Non-Compliance = Massive Penalties 

If your organization hires or contracts with an excluded individual, you must repay all related federal reimbursements. Plus, you could face: 

• Civil Monetary Penalties (CMPs) — up to $20,000 per item/service 
• False Claims Act liability 
• Exclusion from federal healthcare programs, particularly Medicare and Medicaid 

3. Exclusions Are Not Always Obvious. 

Individuals can be excluded under different names, maiden names or aliases. Not all exclusions stem from obvious crimes. Some involve license issues, fraud or administrative findings. 

4. Exclusions Can Happen at Any Time. 

A person not excluded today could be excluded tomorrow. That’s why ongoing, monthly screening is so essential, not just one-time checks during hiring. 

5. It Protects Patients and Upholds Trust. 

Exclusion screening helps prevent unqualified or unethical individuals from delivering care. It’s a cornerstone of patient safety and organizational integrity. 

Regular exclusion screening isn’t just good compliance practice. It’s a regulatory safeguard that protects your organization from fraud, fines and harm to organizational credibility and business integrity. 

So, What Happened at ABC Health? 

The ABC Health board fired the compliance officer; the CEO resigned, and ABC Health declared bankruptcy within six months. The company’s name became a case study in compliance seminars across the country.  

And in a final twist, what happened to the nurse? She vanished before investigators could issue a subpoena. Her exclusion had never expired.  

Moral of the Story: In healthcare compliance, skipping or delaying exclusion screening isn’t just an oversight—it’s a significant risk with high-stake consequences.

Integrating compliance into core business operations strengthens both the compliance program and the broader organization. Below we will identify practical ways to achieve that integration and review the many benefits of taking this approach. 

Gaining Leadership Alignment and Buy-In for Compliance  

Integration begins at the top. When leadership views compliance as a strategic priority – not just a checkbox for audits – it creates a culture where compliance is valued, understood and actively supported. 

Healthcare leaders set the tone by: 

• Including compliance officers/leaders in business planning and strategic discussions. 
• Allocating budgets for compliance initiatives and technologies. 
• Incorporating compliance-related KPIs into department and organizational scorecards. 

Compliance leaders, in turn, support the organization by: 

• Offering proactive guidance on regulatory risks and opportunities. 
• Identifying areas of noncompliance that could lead to penalties or reputational harm.

• Feedback Loops: Ask frontline teams where they’re experiencing friction or confusion with compliance activities. Their insights are invaluable for improving training and processes. 
• Transparency: Share compliance metrics, compliance wins/achievements and areas of specific focus for improvement. 

Regular interaction builds trust and encourages staff to view compliance as a source of support and clarity, not just a department responsible for shining a light on everything that’s going wrong. It positions the compliance team to be viewed as a responsive partner, not just a rule enforcer.  

How to Measure What Matters in Healthcare Compliance 

Let’s face it, you can’t manage what you don’t measure, but you also don’t want to measure everything and anything that can be quantified. Too often, compliance success is evaluated only in terms of audit scores or survey readiness. However, true integration requires broader, more operationally focused metrics. 

Consider including: 

• Time-to-completion or regulatory change tasks/work 
• Staff engagement with compliance training and communications  
• Compliance team onsite/rounding activities 
• Feedback from departments on compliance collaboration

When compliance is fully integrated into everyday operations, it empowers staff, improves performance and protects patients. Just like making any lasting changes, you don’t need to do everything listed above all at once, and most likely you can’t, as these gains take time and effort.  

Start by making small changes. Begin with building key relationships, listening and gathering all the information you need to know to be successful in your integration goals and efforts. Most importantly, never lose track that compliance can become a seamless part of your organization’s operations and a key driver of success.

You know what is so funny about a compliance audit in an ironic and not a ha-ha sort of way? Every organization always touts how audit-ready it is, but the same organization always panics upon notification of an audit or inspection. Why? It’s because you aren’t audit-ready or inspection-ready.  

Audit readiness in quality is no different than anything else – follow a pre-defined process to the letter, tweak it as necessary and continue to evolve it until it works for your organization. It’s not hard. People just panic because the auditor can shut them down. But you wouldn’t panic if you had a process to follow to minimize the damage. So here it is.  

Pre-Audit Steps for Compliance Readiness 

This process assumes you have pre-audit notification a week or so before the audit or inspection occurs. If you don’t, it still may work for you, but you will need to adjust accordingly. The majority of audit and inspection notifications come by e-mail, so take these steps as soon as you receive the notification: 

• Schedule the pre-audit meeting. Get the leadership team together and discuss what the auditor or inspector wants to see.  
• If they want to look at charts, review all the charts in advance before you give any to the inspector.  
• Tour the facility in advance and make it look as presentable as possible.  
• Review all your committee minutes over the last quarter to reacquaint yourself with all your risk areas and what you did to solve them.  
• Finally, notify the entire team that an auditor is coming and review what you should say, as well as what you shouldn’t.  

Audit readiness is as much knowing what not to say as it is knowing what to say. Harsh truth – as a quality professional, I know where the bodies are buried, and I know how to navigate the auditor or inspector around them.  

Also ask the team if anyone knows the auditor, or if they have been to the facility before. Where did they look? What type of auditor were they? Review any previous findings and ensure they are buttoned up and have been addressed. Nothing makes you look worse than getting hit with a duplicate finding that you didn’t do anything about the first time they told you.  

During the Compliance Audit 

Generally, you have an opening meeting where the auditor asks you how things are going. Go in prepared with concise answers about how the program has operated for the last six months. Control the narrative – if they want to tour, for example, already have a plan on who is leading it and where you will take them.  

Determine in advance who you want to interact with the auditor. Don’t risk putting the wrong person in front of the auditor and having your whole plan blow up. 

The rest of the team should live in what we call “zones,” a part of the building that they are responsible for while the auditor or inspector is in the building. If the auditor requests something, give it to them as fast as possible, but don’t give them anything you have not reviewed. Finally, listen attentively during close-out, thank them for their time and discuss next steps.  

Post-Audit Follow-Up Practices 

You generally have 30 days but give the auditor everything they need before they need it. Shoot for half that time to respond. You should do a de-briefing within 24 hours of the audit: 

• What went right 
• What didn’t  
• What do you need to improve on 
• What processes are tight  
• What needs work.  

Respond thoroughly and answer all of their questions. We also recommend a readiness check at 30-, 60- and 90-days post-audit response, so the processes you put in place are sustainable and still working. If not, improve them.  

Be Proactive: Prepare for Your Next Compliance Audit 

Perception is reality. If you look like you know what you’re doing, respond promptly and politely, and treat the auditor with respect, you can generally minimize any damage. Auditors are there to find things, and they generally do. Don’t explain your way out of it or argue with them. Acknowledge, fix and move forward.

Regulations in healthcare change constantly. When a new law or regulation is enacted, compliance teams must act quickly to assess its impact, assign responsibility, and ensure implementation. With regulations often spanning hundreds of pages, how can compliance teams efficiently manage the process without missing critical details? 

It’s important for compliance professionals to identify the who, what, where, when, and how of managing new regulations – and how regulatory change management tools, resources, and software (like YouCompli) streamline this process. 

Step 1. Understand the New Regulation (The What and Where) 

Before action can be taken in response to newly enacted or newly updated regulations, compliance teams must first understand the regulation at hand.  

What does this regulation say? 

That’s right – first things first. Compliance teams must read the regulation. It’s all too common that reading the regulation entails digesting hundreds or more small-print pages from federal and states sources. It’s time-consuming, but it’s necessary as the foundation when understanding what regulations apply to your organization and how. While you may be able to determine fairly quickly that it is in fact not applicable, you must spend a significant amount of time making this determination. 

Which parts of the organization are impacted by this regulation? 

For regulations that are relevant to your organization, the next step is identifying how the business is impacted by this change, and what work, resources, communication, or policy/procedure update may be needed in response. It’s rare that when a new regulation is enacted, it impacts just a single point within a healthcare system, so identifying the impacted departments, service lines, facilities, clinics, and personnel is the next crucial step towards complying with new regulations. This assumes that compliance professionals have a comprehensive list of the services provided within their organization.  

Where does this regulation apply? 

In addition to understanding the impacted services, departments, staff, etc. it is also key to know what locations are affected by the update. Hospital and healthcare systems are very often not isolated to a single state or jurisdiction. This brings with it the need to keep track of locations, and which regulation impacts certain locations, as well as the crossover for regulatory jurisdictions and unique settings or services within your organization.  

Step 2. Assign Responsibility (The Who)  

Once compliance teams are clear on requirements and work needed to comply with new regulations, you must next identify who in the organization is going to be responsible or take ownership of ensuring the work is done. 

Organizations must answer the following to manage regulatory changes: 

• Who is responsible for compliance? The compliance team often leads the process in healthcare organizations, in collaboration with legal, operations, IT, HR, finance, and clinical leadership. Identifying a person, department, or team that is ultimately responsible for compliance is key. 

• Who will implement the required changes? Compliance teams can facilitate this process by providing a clear outline of the required changes and helping the team build a plan to comply. This will often help identify the person, department, or team that makes the most sense to take ownership of implementation.  

• How will compliance monitor and facilitate this process? Compliance teams should identify within operations who is responsible for implementing regulatory changes but should also share responsibility for the success or failure of compliance activities within operations. Compliance teams are a resource, tool, collaborator, and monitor, and can provide guidance for teams tasked with compliance activities.
